A boat accident on the water does not play out like a car crash on the highway. There is no skid mark to measure, and often no other driver to point to. You may not even know yet whose insurance covers what happened to you, or to the person you lost.
As a Morgantown boat accident lawyer team, we have recovered wrongful death settlements of $1.8 million or more for West Virginia families after a single tragedy. No two cases are alike, and a result like that isn’t guaranteed for the next one.
Attorney Edmund Wagoner, who leads these cases for us, spent years representing nursing homes, hospital systems, and insurance companies in West Virginia before he chose to represent injured people instead. That experience shows in how we anticipate an insurer’s defense as a Personal Injury Lawyer.
Tell us where the accident happened and what has happened since, and we’ll walk you through where things stand and help you understand what your case could be worth.

Boating on the Monongahela River, Cheat Lake, and Tygart Lake brings its own risks, and no two boat accident claims look exactly alike. Some involve a single reckless operator. Others involve a marina, a rental company, or a manufacturer whose faulty equipment failed at the worst possible moment.
We represent people hurt in a wide range of recreational and maritime accidents, including:
A boating accident can leave you with more than a stack of medical bills. Head injuries, spinal injuries, and drowning-related brain damage are common, because so few people wear a life jacket once the boat gets moving.
Recovery can mean months away from work, ongoing therapy, and a hospital bill that keeps growing after the insurance company stops answering your calls. Lost wages add up fast, and so does the cost of care for an injury that never fully heals.
According to the U.S. Coast Guard’s most recent Recreational Boating Statistics Report, alcohol use remains the leading known contributing factor in fatal boating accidents across the country, accounting for 92 deaths, or 20 percent of all boating fatalities, in 2024.
For a family that has lost someone, the cost is never really about the dollar figure. The law still requires one, and getting that figure right takes someone who has done it before.
A boat accident claim starts differently than a car accident claim, and the first few days matter most.
Attorney Edmund Wagoner spent years on the other side of the table, representing nursing homes, hospital systems, and insurers, before he chose to represent injured people instead.
That background means we’ve seen the arguments insurance adjusters tend to make, and we’re ready for them.
Morgantown sits along the Monongahela River, and boaters from around North-Central West Virginia head to nearby Cheat Lake and Tygart Lake all summer long. That popularity brings congestion, and congestion brings accidents.
In 2015, a single boat accident on Cheat Lake near Warm Hollow left 12 people injured, with several flown out by helicopter. It is a reminder of how quickly a crowded lake can turn dangerous. Tygart Lake, down near Grafton, draws its own share of boaters every weekend, and its long, narrow shape can make passing and no-wake zones just as risky.
The West Virginia Division of Natural Resources increases patrols on Cheat Lake during Memorial Day, the Fourth of July, and Labor Day weekends for this reason, and DNR officers investigate most serious boating accidents in the area.
If your case goes to court, personal injury claims filed in Morgantown are generally heard at the Monongalia County Circuit Court on High Street, the same courthouse that hears our other injury and wrongful death cases.
Knowing the DNR’s process, and the court that will eventually hear your case, is part of building a claim from day one.
West Virginia law says a boat operator cannot run a vessel in a careless or negligent way. It also says an operator cannot run a motorboat with a blood alcohol level of 0.08 percent or higher (W. Va. Code § 20-7-18). In plain terms, if the person who hurt you broke either of those rules, that violation can support your claim.
You also need to know your deadline. West Virginia generally gives injured people two years from the date of the accident to file a personal injury lawsuit (W. Va. Code § 55-2-12), and two years from the date of death to file a wrongful death claim (W. Va. Code § 55-7-6). Miss that window, and a court can throw out your case no matter how strong it is.
A boat accident claim usually starts with a West Virginia Division of Natural Resources report instead of a police report, and it can involve more than one insurance policy, including the boat owner’s coverage, a marina’s liability policy, or a rental company’s insurance. There is no dash cam footage in most cases, so witness statements and the DNR investigation carry more weight. We handle these differences for you from the first call.
West Virginia law makes it illegal to operate a motorboat while impaired. An operator with a blood alcohol level of 0.08 percent or higher can be held both criminally and civilly responsible for a resulting accident. We can pursue the operator directly, and in many cases, the boat owner or a business that over-served alcohol on the water.
West Virginia law requires the boat owner or operator to file a written accident report with the Division of Natural Resources within 48 hours if someone dies, and within 10 days if the accident causes an injury needing medical treatment or at least $2,000 in property damage. That report often becomes one of the most important pieces of evidence in your claim, and we can help make sure it gets filed correctly.
West Virginia generally gives you two years from the date of the accident to file most boat accident claims, and two years from the date of death in a wrongful death case. Two years sounds like a long time until the evidence disappears, the witnesses move away, or the deadline passes without anyone filing anything. Call us before that clock runs out.
